In a judgment concluded on Tuesday, 27, the Superior Court of Justice (STJ) accepted the request of the Brazilian Football Confederation (CBF) and the São Paulo Football Federation (FPF) and suspended a millionaire indemnity to which the two entities were sentenced in due to the scandal known as the Mafia of the Whistle involved in the 2005 Brazilian Championship.
Both the CBF and the FPF, as well as the former arbitration professionals Edilson Pereira de Carvalho and Paulo José Danelon and the gambler Nagib Fayad, were convicted in the São Paulo Court of Justice due to collective moral damages generated by the results manipulation system of Brasileirão and Paulistão games that season.
Under the command of bettors, led by Fayad, Edilson and Danelon acted in games to manipulate the final leaderboards. For this reason, the Serie A of the 2005 Brazilian Championship had 11 games canceled by the Superior Court of Sports Justice (STJD) as a direct result of the manipulation scandal. The matches were played again.
According to the lawyer who represented the FPF, Bueno, from ASBZ Advogados, the updated amount referring to part of the indemnification of the São Paulo federation was already around R $ 25 million.
The defendants’ request was evaluated by the Third Panel of the STJ and received with a majority of votes, by 3 to 2. The agreement has not yet been published. However, it is worth pointing out that the Public Ministry, the plaintiff, can still appeal against the STJ’s decision.
Brazilian Championship 2005
The 2005 edition of the main football competition in Brazil was marked by investigations based on the denunciations made by a press vehicle during the second round.
Despite all the impasse generated by the qualifications and the markings of 11 matches, Corinthians was crowned Brazilian champion that year, second place went to Internacional. Coritiba, Atlético-MG, Paysandu and Brasiliense were relegated.
