CBF gets involved in a fight with advertising board clubs and claims it has exploitation rights

The Brazilian Football Confederation (CBF) decided to get involved in the fight between 11 teams participating in Serie A of the Brazilian Championship and Sport Promotion. On April 10, the national football authority sent a document to the teams that broke the agreement they had to sell static advertising boards with the agency and closed a new partnership with Brax.

The website Máquina do Esporte published that it had exclusive access to this letter, signed by the legal director of the CBF, Luiz Felipe Santoro, and by Regina Sampaio, legal manager. The message with the document was sent to the 20 teams of the first division on the 10th, after the first three matches of the competition had already been played, one of them with the Brax plates (Atlético-GO 1×1 Flamengo).

In this message, the CBF alleges that “the ownership of the rights to exploit static advertising in the matches of the competitions coordinated by the CBF is the exclusive property of the entity, based on the provisions of articles 136, IV and V, and 147 of its Bylaws, Articles 42, II, 101, caput and paragraph 1, and 106 of the General Regulations for Competitions, as well as article 28 of the Specific Regulations for Series A 2022, a right recognized by the clubs that signed the contractual instrument signed with Sport Promotion”.

In addition, the entity declared that, with this, if the teams disrespect the court decision that established the maintenance of the contract with Sport Promotion, and the CBF is sued, the teams themselves will be held accountable.

“It is important to emphasize that the CBF, attentive to the concerns of the clubs, is analyzing the entire history of the partnership and the contract with due attention and will adopt the appropriate measures, in the appropriate forum and in the legal way, as determined by the contractual instrument”, he explained. .

CBF lists penalties that clubs can suffer in the Brasileirão

Among the penalties that can occur, in addition to a fine for teams, is even the loss of points in the Brasileirão for not complying with the regulation, which determines which arena properties can be exploited. Despite being provided for in the regulation, this type of punishment never went ahead.

For example, Palmeiras, CBF and Globo had this type of problem so that the Allianz Parque brand would not be covered in points that appeared on the TV broadcast. Verdão received no punishment, and the parties reached an agreement.

It is this type of arrangement that the CBF tries to reproduce to end this dispute with the teams and companies that exploit static advertising signs on the lawns. In the document, the institution reinforced that it aims to dialogue to reach an agreement. “It should be noted that such measures are not of direct interest to the CBF, which is willing to engage in dialogue in search of a conceptually reasonable solution for everyone,” the document ratified.

Even with this document passed on to the teams, those who have a contract with Brax did not change their attitude. Fluminense and Fortaleza, who had broken with Sport Promotion, were the only teams to react. Due to the court order, the two clubs decided to continue the plates of the former partner. The other five games that would need to respect the decision of the Justice chose to continue with the Brax plates.
