LOTERJ issues official note on betting regulations in Rio de Janeiro

LOTERJ clarifies that the regulation of sports betting and online gaming in the State of Rio de Janeiro is in full compliance with federal legislation. In accordance with local regulations, specifically with regard to online services, LOTERJ strictly observes the terms of Complementary Law nº 116/2003.

This guarantees full respect for the provisions of Decree-Law No. 6,259/1944, as well as other relevant federal laws and regulations.

It is crucial to highlight that Decree-Law No. 6,259/1944 was established in a context in which physical lottery products predominated. Therefore, the provisions of this decree apply to physical lottery services and not necessarily to virtual modalities.

For example, the document mentions the issuance of physical tickets, their distribution and the holding of draws on specific days.


In view of this, it is clear that the regulations of this diploma regulate physical lottery operations.

Even when applied to the virtual environment, as in the case of accreditation for the operation of public services over the internet, there is no violation of the territorial limits of LOTERJ‘s competence, which is restricted to the State of Rio de Janeiro.

With regard to online betting, governed by article 3 of Complementary Law No. 116/2003, it is essential to highlight that the consumption of these services occurs through explicit acceptance by the consumer.

Thus, recognizing the legal situation established in the State of Rio de Janeiro. Therefore, we do not transgress state territorial limits, as we carry out, provide and consume the activity exclusively within the territory of Rio de Janeiro.

Therefore, these clarifications demonstrate the compliance of LOTERJ’s practices with current legislation. In this way, ensuring the legality and transparency of sports betting and online gaming operations in the State of Rio de Janeiro.

About LOTERJ

Founded in 1944, the Rio de Janeiro State Lottery is responsible for managing the game throughout the state. After the ban on casinos, state lotteries became the official alternative, established by Decree-Law No. 6,259, by President Getúlio Vargas.
