The Ministry of Sports published an ordinance (MESP No. 31) that regulates the inspection of fixed-odds betting sites on sporting events in Brazil.
According to the text, published last Friday (4), in the Official Gazette of the Union, it is up to the National Secretariat of Sports Betting and Economic Development of Sports, through the Directorate of Monitoring and Evaluation of Sports Betting, to establish and coordinate the Technical Team responsible for the periodic analysis of the websites of sports betting operators.
Also according to the document, signed by the Minister of Sports, André Fufuca, the inspection and verification of the compliance of sports betting sites will be carried out systematically and periodically.
In addition, the ministry may develop and implement a platform for the integrity of sports operations in the sector. It may also establish partnerships with regulatory bodies, federal entities, educational and research institutions, as well as universities, technology companies and international organizations to improve inspection tools and processes.
The measure is already in force and, according to the text, it provides that if irregularities are found, the technical team will prepare a detailed report. After identifying and describing the nonconformities, the report is sent to the Prizes and Betting Secretariat of the Ministry of Treasury for the adoption of appropriate measures.

MESP ORDINANCE No. 31, OF APRIL 4, 2025
Regulates the monitoring of fixed-odds betting sites on sporting events in accordance with MESP Ordinance No. 125, of December 30, 2024.
THE MINISTER OF STATE FOR SPORTS, in the exercise of the powers conferred on him by art. 87, sole paragraph, items I and II, of the Federal Constitution, art. 1, item I, of Annex I to Decree No. 11,343, of January 1, 2023, and art. 5 of Interministerial Ordinance MF/MESP/AGU No. 28, of May 22, 2024, resolves:
Art. 1 This Ordinance regulates the inspection procedure for the electronic websites of operating agents authorized to operate the fixed-odds lottery betting modality for real sports-themed events, aiming at compliance with MESP Ordinance No. 125, of December 30, 2024, and its eventual updates.
Art. 2 For the purposes of this Ordinance, the following shall be considered:
I – betting operator agent: legal entity authorized by the Prizes and Betting Secretariat of the Ministry of Treasury to operate fixed-odds bets; and
II – sports modalities or entities not provided for: any sports modalities or sports entities not included in the list established in MESP Ordinance No. 125/2024, of December 30, 2024.
Art. 3 The National Secretariat for Sports Betting and Economic Development of Sports, through the Directorate for Monitoring and Evaluation of Sports Betting, is responsible for establishing and coordinating the Technical Team responsible for the periodic analysis of the websites of sports betting operators.
Sole paragraph. The Technical Team referred to in the caput will be composed of the following members:
I – Director of the Sports Betting Monitoring and Evaluation Department, who will coordinate the Technical Team;
II – 02 (two) General Coordinators of the Sports Betting Monitoring and Evaluation Department; and
III – General Coordinator of the General Coordination for Combating Detrimental Practices in Sports Betting, linked to the Directorate of Integrity in Sports Betting.
Art. 4º The periodic analysis of the websites of sports betting operators must observe compliance with legal and regulatory requirements, covering, among other essential aspects, the following:
I – Verification of the regularity of the commercial brand used by the operating agent, ensuring correspondence with the brand registered in the authorization process before the Prizes and Bets Secretariat of the Ministry of Treasury;
II – Checking the supply of sports modalities, ensuring that they are in compliance with the list provided for in MESP Ordinance No. 125, of December 30, 2024, and any updates thereof; and
III – The identification of possible practices that may constitute a violation of current regulations, such as the offering of prohibited bets, the absence of effective mechanisms to prevent the participation of children and adolescents.
Art. 5 If irregularities are found, the Technical Team will prepare a detailed report, containing a description of the non-conformities, which will be forwarded to the Prizes and Betting Secretariat of the Ministry of Treasury for the adoption of appropriate measures.
Art. 6 The Directorates of Promotion, Entrepreneurship and Digital Economy of Sports, e-Sports and Integrity in Sports Betting, within the scope of their respective competences, will provide technical support to the Directorate of Monitoring and Evaluation of Sports Betting and to the Technical Team in carrying out periodic analyses.
Art. 7 The Ministry of Sports may develop and implement a platform for the integrity of sports operations in the sector, and may also establish partnerships with regulatory bodies, federal entities, educational and research institutions, universities, technology companies and international organizations to improve inspection tools and processes.
Art. 8 This Ordinance shall come into force on the date of its publication.
