For years, the question of a State more aligned with the private initiatives of contests and lotteries has been discussed, and it seems that now the Government wants to follow this concept and trust more in the private sector.

According to the news portal JOTA, the Government is studying the simplification of the rules for commercial promotion of sweepstakes. A process like this can help private initiatives to generate more business, income and jobs.

The government is studying simplifying the requirements for commercial promotion by the private sector and may also raise the rates for registration of these contests and prize draws.

The measure advanced a lot in the technical area of ​​the Ministry of Economy’s Secretariat for Evaluation, Planning, Energy and Lotteries (Secap), still under the management of former secretary Gustavo Guimarães, who left his post last week.

The idea, as found out by JOTA, is that only contests and sweepstakes with values ​​from R$ 10 thousand are required to register with Secap, collecting the fees due. Today, these trade promotions have to be authorized by the government, regardless of the prize amount. Thus, the intention is only to have requirements for events with really significant prizes.

“The simplification of processes for commercial promotions, such as the removal of the authorization requirement for small-scale processes, are in line with a State that trusts the private sector and its ability to generate new business, employment and income. The improvements will also reduce warnings and sanctions, preventing the opening of administrative processes when there are small flaws and there is good faith on the part of the promoter of the action”, Guimarães told JOTA.

Sought after, the substitute secretary of Secap, Fernando Sertã, did not give an interview and the ministry’s advice limited itself to confirming that the topic “is still being debated internally”.

To change the rules for trade promotion, a new law is needed. There is the possibility of a Provisional Measure on the subject. To update the fees that will be charged in operations above R$ 10,000, a decree is enough.

One source says that rates haven’t changed for 20 years, despite the law requiring them to do so. It is charged by award tier. The idea that was on the table was to replace half of the inflation of that period, which would double the values, but until a final decision this can be changed.
