The government of Espírito Santo presented an innovative proposal through Complementary Law Project (PLC) 70/2023, aiming to improve the operation of the Capixaba Lottery.
This initiative, included in the Investment Partnership Program, seeks to regulate the service, replacing the old Law 11,236/2021 and updating the guidelines established by Law 1,928/1964.
According to feasibility assessments carried out by Banco do Estado do Espírito Santo (Banestes), the exploration model proposed in PLC 70/2023 is supported both legally and financially.
The proposal gives the state bank responsibility for the operation and exploitation of the service, in line with the Executive’s objective of boosting revenue.
The project highlights maximizing the potential for obtaining resources for the State as a priority, aligning with the social purposes of collection, in accordance with national legislation.
The allocation of up to 12% of the total resources raised by the lottery for programs in the areas of culture, sports, leisure, social assistance and tourism for the social development of the State.
The project also highlights that it will channel the resources from the prizes not collected by the winners for the purposes mentioned above.
It proposes innovation by allowing flexibility in capturing bets, enabling physical and virtual means, and will establish lottery modalities by decree.
Fiscal control of the Capixaba Lottery
The Public Services Regulatory Agency (Arsp) plays a fundamental role in regulating, controlling and supervising the lottery, ensuring transparency and compliance with established guidelines.
Furthermore, the proposal provides for the possibility of opening additional credits to enable the implementation of the new standard.
The repeal of Law 11,236/2021, which dealt with the previous regulation of the Espírito Santo lottery, and article 2 of Law 1,928/1964 highlights the innovative nature of the proposal, which seeks to align the service with contemporary demands and realities.

Therefore, the state government’s proposal aims to modernize and optimize the Capixaba Lottery, prioritizing collection efficiency, the strategic allocation of resources to social areas and compliance with current regulations.
