Ministry of Treasury defines rules for the use of the ‘bet.br’ domain on betting sites

The Ministry of Treasury, through its Prizes and Betting Secretariat, published a new normative instruction regulating the use of the “bet.br” domain for sports betting sites in Brazil.

The measure aims to structure the fixed-odd sports betting market, offering a safer and more regularized environment for operators and bettors. The instruction is based on the provisions of laws and ordinances that define specific rules for the sector.

“bet.br” domain will be exclusive to legalized bookmakers

With the regulation, all betting sites that wish to use the “bet.br” domain on their electronic channels must meet a series of requirements. Therefore, betting sites must register on the Registro.br portal, managed by the Ponto BR Information and Coordination Center (NIC.br), and must follow a detailed validation and authorization flow.

Therefore, betting sites interested in registering a “bet.br” domain must make the request on the official NIC.br website, as guided by Ordinance SPA/MF No. 827. To be accepted, registrations must:

• Comply with the rules established by NIC.br for contracting domains.
• Be related to trademarks licensed by the Prizes and Betting Secretariat.

The Secretariat will analyze each request, taking into account the registration date and correspondence with registered trademarks. In other words, the objective is to ensure that only authorized operators use the “bet.br” domain, preventing fraud and improving transparency.

But the normative instruction also provides that, if the operator wishes to change the registration of an already approved “bet.br” domain, they must follow the procedures established by NIC.br.

This includes any modification of information or adjustments to the initial registration, keeping the domain in compliance with current regulations. These new rules take effect immediately.

THE SECRETARY OF PRIZES AND BETS OF THE MINISTRY OF FINANCE, in the use of the powers conferred on him by art. 55, caput, item I, item “d”, of Annex I of Decree No. 11,907, of January 30, 2024, and in view of the provisions of art. 29, § 3, of Law No. 13,756, of December 12, 2018, in art. 7th, § 1st, item VII, of Law No. 14,790, of December 29, 2023, and in art. 5th of SPA/MF Ordinance No. 722, of May 2, 2024, resolves:

Art. 1 This Normative Instruction regulates the registration of the domain “bet.br” for use in electronic channels offered by agents operating the fixed-odd betting lottery modality, referred to in art. 5th of SPA/MF Ordinance No. 722, of May 2, 2024.

Art. 2 Fixed-odd betting operating agents must submit a request for registration of the domain “bet.br” on the website https://registro.br/, from the Ponto BR Information and Coordination Center – NIC.br, after the notification referred to in art. 16, caput, of SPA/MF Ordinance No. 827, of May 21, 2024.

Single paragraph. The requests referred to in the caput must:

I – comply with the rules established by the Ponto BR Information and Coordination Center – NIC.br for contracting the service; and

II – indicate the registrations of “bet.br” domains corresponding, at most, to the total of commercial brands to be exploited upon authorization from the Secretariat of Prizes and Bets of the Ministry of Finance, observing the provisions of art. 5 and in item 4.2 of Annex I of Ordinance SPA/MF nº 827, of May 21, 2024.

Art. 3 The Prizes and Betting Secretariat of the Ministry of Finance will examine requests for registration of “bet.br” domains registered at the Ponto BR Information and Coordination Center – NIC.br by fixed-odd betting operating agents and will verify the following criteria:

I – date of registration of the registration request after the date of the notification of authorization referred to in art. 16, caput, of SPA/MF Ordinance No. 827, of May 21, 2024; and

II – indication of registrations of “bet.br” domains corresponding to the trademarks to be exploited upon authorization from the Secretariat of Prizes and Bets of the Ministry of Finance.

Single paragraph. It is mandatory to use Domain Name System Security Extensions – DNSSEC registration technology for registering “bet.br” domains.

Art. 4 In the event of a decision by the Prizes and Betting Secretariat of the Ministry of Finance unfavorable to the request referred to in art. 2nd, after examining the criteria of art. 3rd, fixed-odd betting operating agents will be notified by the Ponto BR Information and Coordination Center – NIC.br, and will be able to send an appeal to the email address cgs.spa@fazenda.gov.br within a period of up to fifteen days from the date of date of receipt of the communication.

Art. 5 Controversies resulting from the registration of “bet.br” domain names between fixed-odd betting operators will be resolved through the Administrative System for Internet Conflicts Relating to Domain Names under “.br” (SACI- Adm), in accordance with the contract for domain name registration under “.br”, available at the electronic address https://registro.br/dominio/contrato/, and with the Regulations of the referred System, available at the address electronic https://registro.br/saci-adm/.

§ 1 In the case of initiation of the procedure referred to in the caput, the personal data necessary for identification and communication with the domain holder and other information that is necessary for the instruction of the procedure will be shared with the institution accredited by the Information and Coordination Center do Ponto BR – NIC.br, responsible for the administration and decision of the procedure, in compliance with the provisions of Law No. 13,709, of August 14, 2018, and upon provision of consent by the holder.

§ 2 In addition to the communication referred to in § 1, personal data to identify the domain holder will be included in the decision to conclude the procedure, which may be published on the websites of the Ponto BR Information and Coordination Center – NIC.br and the accredited institution, upon provision of consent by the holder.

§ 3 The Prizes and Bets Secretariat of the Ministry of Finance will be notified by the Ponto BR Information and Coordination Center – NIC.br of the cases referred to in the caput via the electronic address cgs.spa@fazenda.gov.br, and will be expressed within a period of up to fifteen days from receipt of the communication.

Art. 6 After the favorable decision of the Secretariat of Prizes and Bets of the Ministry of Finance to the request referred to in art. 2nd, based on the examination of the criteria of art. 3rd, fixed-odd betting operating agents must observe the conditions and take the measures indicated by the Ponto BR Information and Coordination Center – NIC.br to register the “bet.br” domains.

Art. 7 The registered “bet.br” domains must be informed by fixed-odd betting operators in a specific field of the Betting Management System – SIGAP of the Prizes and Bets Secretariat of the Ministry of Finance within up to five days of registration date.

Art. 8 Requests to change registrations of already approved “bet.br” domains will follow the procedures defined by the Ponto BR Information and Coordination Center – NIC.br, observing the provisions of this Normative Instruction.

Art. 9 This Normative Instruction comes into force on the date of its publication.
